1. Agreement to Terms
These Terms of Service constitute a legally binding agreement between you (the 'Client') and Deeplytic Europe SL ('Deeplytic,' 'we,' 'us') governing access to and use of our AI detection platform and associated services. By accessing our platform or executing a service agreement, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
2. Service Description
Deeplytic provides enterprise-grade AI-generated content detection services utilizing proprietary machine learning algorithms, computer vision analysis, and forensic verification techniques. Our platform analyzes digital media to identify synthetic manipulations, deepfakes, and AI-generated content. Service capabilities, detection accuracy rates, and response times vary by subscription tier as detailed in your executed service agreement.
3. Acceptable Use Policy
Clients may use Deeplytic services exclusively for lawful purposes compliant with all applicable European Union regulations, national laws, and industry standards. Prohibited uses include but are not limited to:
- Reverse engineering, decompiling, or attempting to extract our proprietary detection algorithms
- Uploading malicious content designed to compromise platform security or integrity
- Processing content that violates third-party intellectual property rights without proper authorization
- Sublicensing, reselling, or providing third-party access without written consent
- Interfering with platform operations or circumventing security measures
4. Service Level Agreements
Deeplytic commits to the uptime guarantees specified in your subscription tier: 99.5% for Protocol Basic, 99.9% for Protocol Advanced, and 99.99% for Protocol Enterprise. Uptime is measured monthly, excluding scheduled maintenance windows announced with 72-hour notice. In the event of SLA breaches, service credits will be applied as specified in your executed agreement. SLA guarantees do not cover outages caused by force majeure events, client configuration errors, or third-party service provider failures beyond our control.
5. Intellectual Property
All detection algorithms, software code, platform architecture, analysis methodologies, and documentation constitute Deeplytic's proprietary intellectual property protected by European Union copyright, trade secret, and patent laws. Clients retain all rights to content uploaded for analysis. Deeplytic retains rights to aggregate, anonymized detection statistics for research and algorithm improvement purposes. Neither party may use the other's trademarks, service marks, or trade names without explicit written authorization.
6. Limitation of Liability
Deeplytic's total liability for any claims arising from service provision shall not exceed the total fees paid by the Client in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages including lost profits, business interruption, or reputational harm. Detection services are provided as analytical tools; final authentication decisions remain the Client's responsibility. Deeplytic does not guarantee 100% detection accuracy and is not liable for undetected synthetic content or false positive identifications.
7. Termination
Either party may terminate service agreements with 30 days' written notice. Deeplytic reserves the right to immediately suspend access upon material breach of these Terms, non-payment, or activities threatening platform security. Upon termination, Clients must cease all use of Deeplytic services and delete any proprietary materials. Fees paid for annual subscriptions are non-refundable except where required by applicable consumer protection laws.
8. Governing Law
These Terms are governed by Spanish law and EU regulations. Disputes shall be resolved through binding arbitration administered by the Madrid Court of Arbitration under Spanish Arbitration Act rules. Arbitration proceedings shall be conducted in English unless parties agree otherwise. Judgment upon arbitration awards may be entered in any court of competent jurisdiction.
